What is Subject to?
A subject-to transaction is a real estate purchase in which ownership of the property transfers to the buyer while the seller’s existing mortgage remains in place. Rather than obtaining new financing, the buyer assumes responsibility for making the monthly payments on the seller’s current loan, which continues to be serviced by the original lender
How does a Subject to transaction benefit the seller?
More cash at closing: Sellers can often walk away with more money than in a traditional sale. Because we base the purchase on the property’s cash flow as a rental rather than its retail value, we may be able to offer a higher payout.

Additionally, our contracts include a performance clause: if the buyer were to default on a payment, the property would automatically revert back to the seller, and the buyer would forfeit all investments made to that point — including cash paid at closing, agent commissions, and closing costs.
While it’s unlikely from an investor standpoint for a buyer to default in this type of transaction, this clause is included as an added safeguard to give sellers peace of mind throughout the process.
